Considerando a situação no mundo nesta época, o artigo visa estabelecer um dialogo analítico sobre os trabalhos publicados em Portugal e no Brasil que de algum modo posicionaram sobre a articulação do desenvolvimento com a educação.

ACESSO À JUSTIÇA: DELINEAMENTOS GERAIS E ANÁLISE NO PROJETO DE NOVO CÓDIGO PROCESSUAL CIVIL.

Background Q-CEP (Qualificação dos Comitês de Ética em Pesquisa que compõem o Sistema CEP/Conep) is a nationwide project resulting from a partnership between the Brazilian National Research Ethics Commission (Conep), the Ministry of Health and Hospital Moinhos de Vento (HMV). It was developed to consolidate policy for ethical review of research with human beings in all members of the CEP/Conep System, Brazil’s national system of institutional review boards. The aim of this study was therefore to report on the experience and (...) results of the Q-CEP project. Methods An observational, retrospective study includes data from the Q-CEP, obtained from visits to all the institutional research ethics committees (RECs) in the country. The actions implemented by Q-CEP were part of a two-step process: (i) training visits to each REC; (ii) development of distance learning modules on strategic topics pertaining to research ethics evaluation. The data presented herein cover step one (training visits), defined by Q-CEP as the diagnostic stage of the project. For a country with social and economics inequalities such as Brazil, this is a particularly important stage; an accurate picture of reality is needed to inform planning of quality improvement strategies. Results In 2019–2021, Q-CEP visited 832 RECs and trained 11,197 people. This sample covered almost all active RECs in the country; only 4 (0.5%) were not evaluated. Of the 94 items evaluated, 62% did not reach the target of at least 80% compliance and around 1/4 (26%) were below 50% compliance. The diagnostic stage of the process revealed inadequacies on the part of the RECs in their ethical reviews. The analysis of informed consent forms showed compliance in only 131 RECs (15.74%). The description of pending issues made by RECs in their reports was compliant in 19.33% (n = 161). Administrative and operational aspects were also considered inadequate by more than half of the RECs. Conclusions Overall, Brazilian RECs showed poor compliance in several aspects of their operation, both in ethics evaluation and in other processes, which justifies additional training. The Q-CEP project is part of a quality improvement policy promoted by the Brazilian Ministry of Health. The data obtained in the diagnostic step of the project have contributed to the qualification and consolidation of one of the world’s largest research ethics evaluation systems. (shrink)

Female sex steroids can affect the motor system, modulating motor cortex excitability as well as performance in dexterity and coordination tasks. However, it has not yet been explored whether FSS affects the cognitive components of motor behavior. Mu is a sensorimotor rhythm observed by electroencephalography in alpha and beta frequency bands in practices such as motor imagery and action observation. This rhythm represents a window for studying the activity of neural circuits involved in motor cognition. Herein we investigated whether the (...) alpha-mu and beta-mu power in the sensorimotor region and the alpha and beta power over frontal, parietal, and occipital regions are modulated differently in the menstrual, follicular, and luteal phases of menstrual cycles in right-handed dominant women. To do so, these women underwent MI and AO in the three menstrual cycle phases. The spectral activity of the cortical regions for the alpha and beta bands were compared between phases of the menstrual cycle and a correlation analysis was also performed in relation to estrogen and progesterone levels. For the hypothesis-based approach, beta-mu event-related desynchronization was significantly stronger in the C3 channel in the follicular phase than in the menstrual and luteal phases. For the data-driven approach, beta ERD during MI was higher in the follicular phase than in the menstrual and luteal phases in the frontal region. These findings suggest the effect of FSS on executive movement control. No effect of menstrual cycle phases was observed in cortical areas investigated during OA, but alpha and beta bands correlated positively with the follicular phase plasma estradiol level. Thus, the attenuation of alpha and beta bands referring to mirror neuron activities appears to be associated with inhibition of cortical activity when estradiol levels are lower, improving cognitive processing of motor action. Este artigo propõe analisar as relações entre o pentecostalismo e o protestantismo “histórico” nos últimos 100 anos. Desde o ano 2010 comemora-se o centenário da chegada do pentecostalismo no Brasil por meio das pregações do ítalo-americano Luis Francescon e dos suecos Daniel Berg e Gunner Vingren. Até os anos 1950, a Congregação Cristã no Brasil e a Assembléia de Deus, resultantes do trabalho dos três, eram os dois maiores exemplos de igrejas pentecostais consolidadas no Brasil. Uma nova explosão pentecostal (...) ocorrida nos anos 1950 voltou a desestabilizar as relações entre protestantes e pentecostais. As igrejas surgidas desde então faziam da cura divina, dos milagres e prodígios o centro de suas atividades. Mas, no decorrer do século passado houve um crescente acirramento da competição, conflitos, sincretismo e acomodação. Isso se tornou mais forte após os anos 1970, quando um pentecostalismo com maior capacidade competitiva passou a levar vantagem. Esses neopentecostais cresceram em números, porém, ao ampliar os seus respectivos universos simbólicos, incorporaram símbolos, crenças e se tornaram portadores de teologias e discursos, híbridos e sincréticos. Que futuro tais acertos e desacertos poderão trazer para o campo religioso do País? Since 2010 there have been celebrations of the 100 th anniversary of the establishment of Pentecostalism in Brazil, featuring renowned preachers such as the Italian-American Luis Francescon and Swedish Daniel Berg and Gunnar Vingren. Until the 1950s, the Christian Congregation in Brazil and Assembly of God, which resulted from the work of these three preachers, were the two major Pentecostal churches in Brazil. A new Pentecostal outbreak in the 1950s shook up the relations between Protestants and Pentecostal once again. Until then, Pentecostal churches centered their activities on divine healing and miracles. But in the last century, there was a process of intensification of the competition, conflicts, syncretism and complacency within the religious scenario, which accelerated after the 1970s, when a more competitive Pentecostalism started to advance. These neo-Pentecostals grew in numbers, and while expanding their symbolic universes, they incorporated symbols and beliefs, becoming the bearers of a hybrid and syncretic theology and rhetoric. O presente trabalho busca analisar a hermenêutica no Caso do Ex-Deputado Daniel da Silveira, do inquérito n° 4.781 até a sentença da Ação Penal n° 1.044, porém que a Ação Penal n° 937 também foi convocada para o cotejo, abordando decisões e fundamentos durante o trâmite, bem como jurisprudências pretéritas comparadas com as concebidas no caso do parlamentar aqui abordado. A problemática em questão, ademais, é se a referida hermenêutica está de acordo com os métodos próprios desta ciência (...) e quais métodos foram utilizados, bem como as escolásticas e fontes do direito que se podem atribuir, pois que o evento foi duramente criticado, devendo ser analisada tal questão sob óculos técnicos quanto a interpretação da Corte Maior e pelo que pese uma reflexão substancial sobre o porte do Supremo Tribunal Federal no caso acima trazido, em pronta hipótese têm-se que a hermenêutica utilizada foi demasiadamente extensiva e tendendo mais ao método Cientifico-Espiritual em certos momentos, porém em outros mais afeito a Tópica-Problemática, foi utilizada, nesta pesquisa, método bibliográfico e qualitativo. This book contributes to two debates and it does so by bringing them together. The first is a debate in metaethics concerning normative reasons, the considerations that serve to justify a person’s actions and attitudes. The second is a debate in epistemology concerning the norms for belief, the standards that govern a person’s beliefs and by reference to which they are assessed. The book starts by developing and defending a new theory of reasons for action, that is, of practical reasons. (...) The theory belongs to a family that analyses reasons by appeal to the normative notion of rightness (fittingness, correctness); it is distinctive in making central appeal to modal notions, specifically, that of a nearby possible world. The result is a comprehensive framework that captures what is common to and distinctive of reasons of various kinds: justifying and demanding; for and against, possessed and unpossessed; objective and subjective. The framework is then generalized to reasons for belief, that is, to epistemic reasons, and combined with a substantive, first-order commitment, namely, that truth is the sole right-maker for belief. The upshot is an account of the various norms governing belief, including knowledge and rationality, and the relations among them. According to it, the standards to which belief is subject are various, but they are unified by an underlying principle. (shrink)

A trenchant defense of hierarchy in different spheres of our lives, from the personal to the political All complex and large-scale societies are organized along certain hierarchies, but the concept of hierarchy has become almost taboo in the modern world. Just Hierarchy contends that this stigma is a mistake. In fact, as Daniel Bell and Wang Pei show, it is neither possible nor advisable to do away with social hierarchies. Drawing their arguments from Chinese thought and culture as well (...) as other philosophies and traditions, Bell and Wang ask which forms of hierarchy are justified and how these can serve morally desirable goals. They look at ways of promoting just forms of hierarchy while minimizing the influence of unjust ones, such as those based on race, sex, or caste. Which hierarchical relations are morally justified and why? Bell and Wang argue that it depends on the nature of the social relation and context. Different hierarchical principles ought to govern different kinds of social relations: what justifies hierarchy among intimates is different from what justifies hierarchy among citizens, countries, humans and animals, and humans and intelligent machines. Morally justified hierarchies can and should govern different spheres of our social lives, though these will be very different from the unjust hierarchies that have governed us in the past. A vigorous, systematic defense of hierarchy in the modern world, Just Hierarchy examines how hierarchical social relations can have a useful purpose, not only in personal domains but also in larger political realms. I argue that there is a tension between two of the most distinctive theses of Sven Rosenkranz’s Justification as Ignorance: the central thesis concerning justification, according to which an agent has propositional justification to believe p iff they are in no position to know that they are in no position to know p and the desire to avoid logical omniscience by imposing only “realistic” idealizations on epistemic agents.

Recently, a view I refer to as “hypothetical continuism” has garnered some favour among philosophers, based largely on empirical research showing substantial neurocognitive overlaps between episodic memory and imagination. According to this view, episodically remembering past events is the same kind of cognitive process as sensorily imagining future and counterfactual events. In this paper, I first argue that hypothetical continuism is false, on the basis of substantive epistemic asymmetries between episodic memory and the relevant kinds of imagination. However, I then (...) propose and defend an alternative form of continuism, according to which episodic memory is continuous with a capacity I call “actuality-oriented imagination.” Because of the deep epistemic affinities between episodic memory and actuality-oriented imagination, it makes sense to think of them as cognitive processes of the same kind. I present an exemplary Humean modal epistemology. My version takes inspiration from but incurs no commitment to both Hume’s historical position and Lewis’s Humeanism. Modal epistemology should meet two challenges: the Integration challenge of integrating metaphysics and epistemology and the Reliability challenge of giving an account of how our epistemic capacities can be reliable in detecting modal truth. According to Lewis, modal reasoning starts from certain Humean principles: there is only the vast mosaic of spatiotemporally distributed local matters of fact. (...) The facts can be arbitarily recombined. These principles cannot be taken for granted. I suggest a bottom-up approach instead: Humean principles of recombining the mosaic of facts can be retrieved from the evolutionarily instilled and empirically informed use of imagination in exploring everyday circumstantial possibilities. This use of imagination conforms to a primitive conception of matter as freely recombinable. The modal beliefs that can be obtained from generalizing the more elementary exercise of imagination have to be corrected. Recombination is limited by sortal criteria of identity. Moreover, the overall picture of a recombinable spatiotemporal mosaic must be weighed against the results of science. (shrink)

According to the cluster of theories in the metaphysics of properties known as ‘trope’ theories, properties are collections of particular qualitative instances. Though increasingly influential, the cluster is sufficiently diverse for there to be little agreement as to the prospects of its members. The present essay articulates and defends a conception of tropes as primitively qualitatively complex, somewhat in the vein of Quinean nominalist objects. After clarifying the relationships among tropes, properties, property exemplification, and property conferral, the essay discusses the (...) benefits of this new ‘ostrich’ trope theory. Specifically, the theory explains better than prior trope theories both the spatiotemporal status of tropes and the capacity tropes have to confer properties onto objects. Moreover, the theory is immune to many of the concerns that threaten more orthodox trope ontologies. (shrink)

There is a broad consensus in the literature that in the section on ‘The Genus’ in theScience of Logic, Hegel argues that any living being must exist among other instances of its kind, with which it reproduces to create future generations, and out of which it was itself produced. This view is not only hard to motivate philosophically, it also seems to contradict many things Hegel says elsewhere in his system about the details of living nature, especially concerning the reality (...) of spontaneous generation. After an examination of the secondary literature on ‘The Genus’, I offer an alternative view of this section, which I call ‘the Modal Reading’. The Modal Reading sees the language of pluralities in ‘The Genus’ as really Hegel's peculiar way of articulating certain modal features of thoughts about the living: to grasp a living individual as living, we need to distinguish not only between this individual and its environment, but also between the things this individual actually does and other possibilities which it does not actualize. The Modal Reading has a logical motivation insofar as it articulates what is needed to think of a living being as living, but it also avoids saddling Hegel with the problematic entailments he is usually read as taking on in this section. A further upshot of the Modal Reading is that approaching Hegel in this way provides us with a way to see Hegel as defending a non-nominalistic alternative to essentialist accounts of living kinds. Finding a way to read ‘The Genus’ which coheres with Hegel's views elsewhere in his system thus shows Hegel to have been an especially subtle and penetrating thinker, with continuing relevance for the philosophy of biology. A thorny question surrounding the meaning of ought concerns a felt distinction between deontic uses of ought that seem to evaluate a state of affairs versus those that seem to describe a requirement or obligation to perform an action, as in and, respectively. There ought not be childhood death and disease. You ought to keep that promise. Various accounts have been offered to explain the contrast between “agentive” and “non-agentive” ought sentences. One such account is the Agency-in-the-Prejacent theory, which traces (...) the difference to a particular kind of ambiguity in the prejacent. This theory has been criticized as linguistically unviable. Indeed, I level a few novel complaints against AIP myself in the present paper. But AIP has a kernel of genuine insight which allows us to explain the contrast—that the distinction between agentive and non-agentive ought sentences owes in part to the way natural language encodes information about agency. I develop this idea into a novel account that, like AIP, traces the contrast to an ambiguity in the complement of the modal. However, according to the view I propose, the Coercion View, a linguistically-motivated coercion operation produces the necessary grammatical conditions for agentive ought, which in turn allow a kind of variadic function operator in the style of to produce the semantic effect we see on display in agentive readings of ought. Having explained the mechanism by which we get this structure, I show that it corroborates some of the central intuitions underwriting agentive ought. I submit that the Coercion View offers an explanation of agentive ought to take at least as seriously as any of its competitors. (shrink)

Digital twinning in medicine refers to the idea of simulating a person’s organs, muscles or perhaps their entire body, in order to arrive more effectively at accurate diagnoses, to make treatment recommendations that reflect chances of success and possible side-effects, and to better understand the long-term trajectory of an individual’s overall condition. Digital twins, in these ways, build on the recent movement toward personalised medicine,1 and they undoubtedly present us with exciting opportunities to advance our health. Of course, the opportunities (...) are accompanied by newfound challenges—a common refrain in discussions surrounding emerging technologies. In a recent article, Matthias Braun surveys numerous problems, including the precision of simulations, ownership and consent to the use of digital models, and issues of justice in assuring equitable access to novel medical systems.2 In particular, he places special emphasis on the notion of representation. According to Braun, proper representation naturally calls for correspondence—namely a precise model offering dynamic, real-time feedback as well as transparency, both for the patient and the practitioner, in terms of the data being employed. While technical challenges remain, these goals are quite clear and relatively uncontroversial. Where a host of questions arise, however, is in the discussion on the interaction between the represented persons and their simulations. This book examines the divine nature in terms of maximal greatness. It investigates each attribute associated with maximal greatness - omnipotence, omniscience, perfect goodness, eternity, and beauty, arguing that maximal greatness is necessary and sufficient for divinity.

Western representation of countries from the Global South implies a dichotomist view of business ethics: on the one hand, universal ethics largely reproduces commonsensical views of the South as ‘less ethical’, and on the other hand, voices from the South are often conditioned to present themselves as substantially indigenous and unambiguous to be accepted as legitimate ethical subjects. We join the growing interest in bridging this gap by drawing on studies from human geography, and ask to what extent the materiality (...) of moral dilemmas bespeaks the disputed underpinning ethical values of a given space. Drawing on Henri Lefebvre’s perspective of the production of social space, we outline and apply the idea of ‘spatial ethics’ to organizations, in order to approach the entanglement between center and periphery. We analyze organizations in favelas, which are, for many authors, territories where experiences are extreme, and poverty and violence mix with vibrant culture and ingenuity. We critically approach the field of business ethics and suggest that one way of moving beyond the North–South debate is to consider that ethics cannot be transmitted or represented in empty milieus. The primary claim of this paper is that intellectual conflicts of interest (COIs) exist but are of lower ethical priority than COIs flowing from relationships between health professionals and commercial industry characterized by financial exchange. The paper begins by defining intellectual COIs and framing them in the context of scholarship on non-financial COIs. However, the paper explains that the crucial distinction is not between financial and non-financial COIs but is rather between motivations for bias that flow from relationships and those (...) that do not. While commitments to particular ideas or perspectives can cause all manner of cognitive bias, that fact does not justify denying the enormous power that relationships featuring pecuniary gain have on professional behaviour in term of care, policy, or both. Sufficient reason exists to take both intellectual COIs and financial COIs seriously, but this paper demonstrates why the latter is of higher ethical priority. Multiple reasons will be provided, but the primary rationale grounding the claim is that intellectual COIs may provide reasons to suspect cognitive bias but they do not typically involve a loss of trust in a social role. The same cannot be said for COIs flowing from relationships between health professionals and commercial industries involving financial exchange. The paper then assumes arguendo that the primary rationale is mistaken and proceeds to show why the claims that intellectual COIs are more significant than relationship-based COIs are dubious on their own merits. While solid organ transplantation for patients with substance use issues has attracted ethical discussion, a typology of the ethics themes has not been articulated in the literature. We conducted a scoping review of peer-reviewed literature on solid organ transplantation and substance use published between January 1997 and April 2016. We aimed to identify and develop a typology of the main ethical themes discussed in this literature and to identify gaps worthy of future research. Seventy articles met inclusion criteria and underwent (...) inductive content analysis. Four main ethical themes were identified: (1) personal responsibility; (2) utility; (3) moral character; and (4) fairness. Each theme had multiple sub-themes and there was substantial overlap between themes. This scoping review identified a disproportionate emphasis in the literature regarding personal responsibility, which was referenced by each of the other themes, and a narrow focus on alcohol and liver. We recommend future research further investigate these connections between ethical themes and focus on ethical issues associated with transplants from organ groups other than liver for patients who use substances other than alcohol. The aim of this paper is to examine Francis Glisson’s theory of perception insofar as it concerns the lowest class of living beings: plants. Plants have a special status, they are located between inanimate objects and animals in the hierarchy of being. Unlike the former, they are organic, but unlike the latter they are unconscious. Peculiar to Glisson is the claim that vegetative organization requires self-referential perception. In light of traditional epistemology, this claim may sound puzzling, because we tend to (...) associate self-representation with conscious thought. In order to make sense of Glisson’s self-referential, but unconscious perceptions, the first part of the paper investigates the role of perception in the vegetative process of organization. The second part is a comparative study on two ways of drawing the distinction between unconscious perceptions and conscious sensations. The first one is the Cartesian approach as outlined by Antoine Arnauld in the early 1680s, the second one is Glisson’s theory. In light of the comparison it is argued that Glisson’s is a higher order theory of sensation in which the phenomenon of consciousness requires the delimitation of the all-inclusive, self-referential nature of perception. Santayana the Philosopher: Philosophy as a Form of Life highlights the far-ranging nuances of Santayana’s philosophical system, while also discussing his ever-present concern for contemporary human affairs. Santayana understood the activity of philosophy in a Greek manner, as a form of life, but his interests always included the perennial philosophical questions and how they related to the present.

Would you want to be operated on by a surgeon trained at a medical school that did not evaluate its students? Would you want to fly in a plane designed by people convinced that the laws of physics are socially constructed? Would you want to be tried by a legal system indifferent to the distinction between fact and fiction? These questions may seem absurd, but there are theories being seriously advanced by radical multiculturalists that force us to ask such questions. (...) These scholars assert that such concepts as truth and merit are inextricably racist and sexist, that reason and objectivity are merely sophisticated masks for ideological bias, and that reality itself is nothing more than socially constructed mechanism for preserving the power of the ruling elite. In Beyond All Reason, liberal legal scholars Daniel A. Farber and Suzanna Sherry mount the first systematic critique of radical multiculturalism as a form of legal scholarship. Beginning with an incisive overview of the origins and basic tenets of radical multiculturalism, the authors critically examine the work of Derrick Bell, Catherine MacKinnon, Patricia Williams, and Richard Delgado, and explore the alarming implications of their theories. Farber and Sherry push these theories to their logical conclusions and show that radical multiculturalism is destructive of the very goals it wishes to affirm. If, for example, the concept of advancement based on merit is fraudulent, as the multiculturalists claim, the disproportionate success of Jews and Asians in our culture becomes difficult to explain without opening the door to age-old anti-Semitic and racist stereotypes. If historical and scientific truths are entirely relative social constructs, then Holocaust denial becomes merely a matter of perspective, and Creationism has as much "validity" as evolution. The authors go on to show that rather than promoting more dialogue, the radical multiculturalist preferences for legal storytelling and identity politics over reasoned argument produces an insular set of positions that resist open debate. Indeed, radical multiculturalists cannot critically examine each others' ideas without incurring vehement accusations of racism and sexism, much less engage in fruitful discussion with a mainstream that does not share their assumptions. Here again, Farber and Sherry show that the end result of such thinking is not freedom but a kind of totalitarianism where dissent cannot be tolerated and only the naked will to power remains to settle differences.
